Terms of Service

1. The agreement

These Terms are an agreement between you and ACheetah Trading Import-Export Sole Co., Ltd (enterprise code 01-00031844, Vientiane Capital, Lao PDR — "we", "us") for the Tingting POS mobile application, the STOR marketplace and related services ("the App"). You must be at least 18 years old. If you use the App for a business, you confirm you may accept these Terms on its behalf.

2. Your licence

We give you a limited, non-exclusive, non-transferable, revocable licence to use the App for your business. You may not:

• Sell, sub-license or resell the App;
• Copy, modify or build derivative works from it;
• Reverse engineer or decompile it, except where the law allows;
• Remove our notices, or try to get around security or usage limits.

3. Acceptable use

You must use the App lawfully. You must not use it to:

• Sell illegal, counterfeit, stolen or prohibited goods under Lao law;
• Commit fraud or money laundering, or mislead buyers or customers;
• Send spam, or message people who have not contacted your shop or agreed to hear from it;
• Access other users' data or accounts without permission, or upload malicious code;
• Harass or harm staff, customers or other users.

4. If you run a shop

4.1 Data about your customers and staff

You decide what you record about your customers and staff, and you are responsible for it (see the Privacy Policy, section 2). In particular you must:

• Have a lawful reason for the data you enter, and tell your customers and staff how you use it;
• Tell your staff before you require selfies or location at check-in, and use them only to confirm attendance;
• Handle job applicants' documents only to decide on their application;
• Answer your customers' and staff's requests about their data. We will help you do this.

4.2 Connected channels

When you connect a Facebook Page or a WhatsApp Business number, you must follow Meta's terms and policies, including the WhatsApp Business policies. You may disconnect a channel at any time in the App.

4.3 Staff access

You control which staff can see and do what. You are responsible for actions taken by accounts you give access to your shop.

5. The assistant

The App includes an assistant that can draft replies to customers, read order details from a conversation and answer business questions. It uses third-party AI services (Google Gemini and Anthropic Claude); see the Privacy Policy, section 5.

• The assistant replies to customers only when you turn it on. You can pause it or take over any conversation.
• Its answers can be wrong. Replies it sends to customers are sent in your shop's name, and you are responsible for them. Check prices, stock and order details.
• Answers to business questions are for information only and are not financial, tax or legal advice.

6. Fees

• The core App can be used free of charge.
• Some features use assistant credits or a paid plan. A free daily allowance may apply. Prices are shown in the App before you pay.
• Payment is by bank transfer. A plan or credits are activated after we confirm your payment slip.
• Payments are not refundable, except where Lao law requires, or where we fail to provide what you paid for.
• We will give at least 30 days' notice in the App before we raise prices for a plan you already use.

7. STOR marketplace

• STOR lets shops list products and buyers order them. The sale is between the buyer and the shop; we provide the platform.
• Shops that sell on STOR must pass an identity check and keep their listings accurate. We may remove listings or suspend selling that break these Terms or Lao law.
• We charge shops a commission on STOR orders (currently 5%), taken from the shop's credits. It is returned when an order is cancelled, rejected or returned, except where a dispute finds the shop at fault. Orders a shop receives through its own Messenger or WhatsApp are not charged.
• Buyers and shops should first resolve problems with each other; either can open a dispute in the App, and our decision on a dispute is final within the App.

8. Partners and creators

If you join our partner or creator programme you earn commissions under the programme rules shown in the App. You must give accurate payout details, and you may not earn from your own orders or from misleading promotion. We may withhold commissions obtained by fraud and end your participation.

9. Ownership

The App — its design, code, name and content — belongs to ACheetah Trading Import-Export Sole Co., Ltd or its licensors. Your business data stays yours. You give us permission to store and process it only to provide the App to you.

10. Availability and warranties

The App is provided "as is" and "as available". We work to keep it running and your data safe, but we cannot promise it will be free of errors or interruptions, including interruptions caused by the services we rely on (such as Google, Meta or AI providers). Keep your own records of important information.

11. Limitation of liability

To the extent Lao law allows, we are not liable for:

• Loss of profit, revenue, business or savings;
• Indirect or consequential loss;
• Loss caused by a third-party service outage, or by relying on assistant answers without checking them.

Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Suspension and ending

You can stop using the App and delete your account at any time in Settings → Delete My Account (see the Privacy Policy, section 8). We may suspend or close an account, a marketplace listing or a partner account that breaks these Terms, is used for fraud or illegal activity, or endangers the App or other users. Where we can, we will tell you why.

13. Law and disputes

These Terms are governed by the laws of the Lao People's Democratic Republic. Please contact us first at admin@tingtingpos.app so we can try to resolve a problem; otherwise disputes go to the courts of Vientiane Capital.

14. Changes

We may update these Terms. We will tell you in the App before a significant change takes effect and update the date above. If you do not accept a change, you may stop using the App and delete your account.
